Partnership Firm Registration Procedure (India)
1. Choose a Name for the Firm
Must be unique and not similar to existing
firms.
Should not contain words like Emperor, Crown,
Empire, or Government unless approved by the government.
2. Create a Partnership Deed
The Partnership Deed must include:
1.
Name
and address of the firm and all partners
2.
Nature
of business
3.
Capital
contribution by each partner
4.
Profit
sharing ratio
5.
Duties
and obligations of partners
6.
Other
clauses (salary, interest on capital, dispute resolution, etc.)
It should be printed on nonjudicial stamp paper and signed by
all partners.
3. Application for Registration
Submit an application in Form 1 (or as prescribed by the
respective State) to the Registrar of Firms in the region where the business is
located.
Attach the following:
1.
Duly
filled Form 1
2.
Certified
copy of Partnership Deed
3.
Ownership
proof or rental agreement of business place
4.
Affidavit
declaring the intention to become partners
5.
Payment
of registration fee (varies by state)
4. Verification by
Registrar
The Registrar will verify
all documents.
If everything is in
order, the firm is entered into the Register of Firms.
5. Issuance of
Certificate
After successful
registration, the Registrar issues the Certificate of Registration.
